These Terms & Conditions govern your use of the Jewels by Panache website, services, and the purchase of our products. By accessing our website or placing an order, you agree to be bound by these Terms & Conditions.
1. General
Jewels by Panache operates as an online and appointment-based jewellery business offering bridal jewellery, fashion jewellery, and custom-made pieces.
We reserve the right to amend these Terms & Conditions from time to time. Any changes will take effect upon publication on our website. Your continued use of our website or services constitutes acceptance of the updated Terms.
2. Products and Descriptions
We make every effort to ensure that product descriptions, images, and pricing are accurate.
However:
- Minor variations in colour, finish, size, or detailing may occur.
- Handcrafted jewellery may contain slight natural variations.
- Natural stones, pearls, and beads may display unique inclusions or characteristics.
- Product images may appear differently depending on lighting conditions and individual screen settings.
These variations are a normal feature of handcrafted and natural materials and are not considered manufacturing defects.
3. Orders and Acceptance
All orders placed through our website, social media platforms, or direct sales channels are subject to acceptance.
We reserve the right to:
- Refuse or cancel an order where reasonably necessary;
- Limit quantities purchased;
- Decline orders suspected of fraud, unauthorised activity, or misuse.
An order is considered accepted only after payment has been successfully received and confirmed.
4. Pricing and Payment
Unless otherwise stated, all prices are listed in Australian Dollars (AUD).
Prices may change without notice.
Payments are processed through secure third-party payment providers. Jewels by Panache does not store complete credit card information.
If a pricing error occurs, we reserve the right to correct the error and, where necessary, cancel the affected order and provide an appropriate refund.
5. Custom and Made-to-Order Jewellery
Custom and made-to-order pieces are subject to:
- Customer approval of the design before production;
- Any required non-refundable deposit;
- Production timeframes discussed at the time of order;
- Payment of any remaining balance before dispatch or collection.
Once production has commenced, custom orders generally cannot be cancelled, modified, or refunded except where required under Australian Consumer Law.
6. Bridal Appointments
Bridal consultations and appointments are subject to availability.
We reserve the right to:
- Reschedule or cancel appointments where reasonably necessary;
- Limit the number of guests attending consultations;
- Require appointment deposits where applicable.
Late arrivals may result in a shortened consultation or the need to reschedule.
7. Shipping and Delivery
Shipping and delivery are governed by our Shipping Policy.
Estimated delivery timeframes are provided as a guide only and may vary due to courier operations, weather events, customs processing, or other circumstances outside our reasonable control.
Subject to your rights under Australian Consumer Law, we are not responsible for delays caused by third-party courier services.
8. Returns, Refunds and Exchanges
Our Returns and Refund Policy forms part of these Terms & Conditions.
Unless required by Australian Consumer Law:
- Earrings cannot be returned or exchanged for hygiene reasons.
- Jewellery sets containing earrings cannot be separated for return purposes.
- Change-of-mind returns or exchanges are not accepted.
- Custom and made-to-order jewellery is final sale.
Nothing in these Terms excludes or limits any rights or remedies available under Australian Consumer Law.
9. Damaged or Faulty Items
If your order arrives damaged or you believe an item is faulty, please contact us as soon as possible.
To assist with the assessment process, we may request:
- A continuous unboxing video;
- Photographs of the item and packaging;
- Notification within 10 hours of delivery where reasonably possible.
We will assess the matter and, where appropriate, provide a repair, replacement, or refund in accordance with Australian Consumer Law.
10. Jewellery Care
Jewellery should be handled and stored carefully.
We are not responsible for damage resulting from:
- Water exposure;
- Contact with perfumes, cosmetics, or chemicals;
- Excessive sweat or body oils;
- Improper storage or handling;
- General wear and tear through normal use.
Customers should follow our Jewellery Care recommendations to help preserve the condition of their pieces.
11. Intellectual Property
All content published by Jewels by Panache, including but not limited to:
- Jewellery designs;
- Product photography;
- Logos and branding;
- Website content;
- Marketing materials;
- Graphics and creative assets;
is owned by or licensed to Jewels by Panache and is protected by applicable intellectual property laws.
No content may be copied, reproduced, distributed, modified, or used without our prior written consent.
12. Third-Party Services
We may engage third-party providers for services including:
- Payment processing;
- Shipping and logistics;
- Website hosting;
- Analytics and marketing.
These providers operate under their own terms and privacy policies. Jewels by Panache is not responsible for their independent actions or services.
13. Limitation of Liability
To the maximum extent permitted by law, Jewels by Panache excludes liability for indirect, incidental, special, or consequential loss arising from the use of our products or services.
Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under Australian Consumer Law or other applicable legislation.
14. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia.
Any dispute arising in connection with these Terms shall be subject to the jurisdiction of the courts of New South Wales.
