Custom Order Agreement

Jewels by Panache

This Custom Order Agreement applies to all bespoke, personalised, and made-to-order jewellery created by Jewels by Panache.

By placing a custom order, you acknowledge that you have read and agree to the following terms.


1. Order Confirmation

A custom order is considered confirmed only when all of the following have occurred:

  • The design has been approved by the customer;
  • Any required deposit has been received;
  • Order specifications have been confirmed in writing via email, WhatsApp, invoice, or another approved communication method.

Production will not commence until these requirements have been satisfied.


2. Design Approval

Customers are responsible for carefully reviewing and approving all design details, including:

  • Design sketches or reference images;
  • Material selection;
  • Stone type, colour, or finish;
  • Measurements and sizing;
  • Any other specifications relevant to the order.

Once final approval has been provided, production will proceed according to the approved design.

Changes requested after approval may not be possible and, where accepted, may incur additional costs and revised production timelines.

Design Ownership: Any sketches, concepts, design files, or creative work prepared by Jewels by Panache remain the intellectual property of the business unless otherwise agreed in writing and may not be copied, reproduced, or used by third parties.


3. Payment Terms

Custom orders require:

  • Payment of any applicable non-refundable deposit before production begins;
  • Full payment of the remaining balance before dispatch or collection.

Failure to complete payment may result in delays to delivery or cancellation of the order. Deposits already paid will not be refunded except where required by Australian Consumer Law.


4. Production Timeframes

Estimated production timelines will be discussed at the time of ordering.

As custom jewellery is handcrafted, production times may be affected by factors including:

  • Artisan availability;
  • Material or stone sourcing;
  • Design complexity;
  • Peak bridal or festive seasons;
  • Circumstances beyond our reasonable control.

Production timeframes are estimates only and are not guaranteed.


5. Cancellations and Modifications

Once a custom order has been confirmed and production has commenced, cancellation or modification requests may not be possible.

As each piece is created specifically for the customer, deposits and payments are generally non-refundable except where required under Australian Consumer Law.


6. Natural and Handcrafted Variations

Custom jewellery is individually handcrafted, and minor variations are part of the creation process.

Customers acknowledge that:

  • Slight variations in finish, texture, or detailing may occur;
  • Natural stones, pearls, and beads may differ in colour, tone, or inclusions;
  • Small differences between design references and the completed piece may occur due to the handcrafted nature of the product.

These characteristics are not considered defects.


7. Customer Responsibilities

The customer is responsible for:

  • Providing accurate measurements and sizing information;
  • Confirming all design approvals;
  • Reviewing quotations, invoices, and order details before final approval;
  • Promptly responding to requests for information or approvals.

Jewels by Panache is not responsible for errors or delays resulting from incorrect or incomplete information supplied by the customer.


8. Completion and Delivery

Upon completion:

  • Final photographs or videos may be provided where applicable;
  • The remaining balance must be paid before dispatch or collection;
  • Delivery will be subject to our Shipping Policy.

Subject to Australian Consumer Law, the risk of loss or damage transfers to the customer once the order has been delivered to the nominated address.


9. Returns and Refunds

As custom jewellery is created specifically to the customer's requirements:

  • Custom orders are generally non-refundable;
  • Custom orders are generally non-exchangeable;
  • Custom orders generally cannot be cancelled once production has commenced.

Nothing in this Agreement excludes or limits any rights or remedies available under Australian Consumer Law.


10. Agreement

By placing a custom order with Jewels by Panache, you confirm that you have read, understood, and agreed to this Custom Order Agreement.
